Ministry of Road Transport and Highways

On 18-4-2023, the Ministry of Road Transport and Highways notified the All India Tourist Vehicles (Permit) Rules, 2023. The provisions will come into force on 1-5-2023.

Key Points:

1. Application for All India Tourist Permit (‘Permit’):

• Will be granted only to a tourist vehicle (‘vehicles’) of tourist vehicle operator.

• Application for grant of permit/ renewal will be made electronically on the portal of the Transport Authority (‘Authority’) in Form 1.

• Authority will issue Permit within 7 days from the date of receipt of application.

• The Annual Fee must be accompanied by the Application categorized according to the vehicle’s passenger capacity (excluding driver). Provision for quarterly fee submission is also available.

• Permit without payment of any permit fee will be granted only to:

✓ Battery operated vehicles

✓ Vehicles driven on methanol/ ethanol fuel

2. In case, the Authority takes no decision within 7 days, the Permit will be deemed to have been granted.

3. The Permit will be granted on Form 2 and will be valid for 90 days or its multiple but not exceeding 5 years at a time.

4. A Permit will not be granted to any vehicle which has completed 12 years of its registration.

5. In case of diesel vehicles, registered in Delhi, a Permit will not be granted after the vehicle has completed 10 years of its registration.

6. The fee collected for the Permit will be distributed among the States and Union territories.

7. Scope and Validity:

• Valid everywhere in India.

• Permit should be used for the transport of tourists individually/ in group with their luggage.

• A vehicle should not be used for the transport of tourists unless a Permit is granted.

8. The jurisdictional Authority can permit any tourist vehicle covered by Permit to replace with a vehicle of the same nature.

9. The distinguishing mark “All India Tourist Permit” will have to be prominently displayed on the rear left side of vehicle in white letters in blue background along with the validity of permit.

10. Permit will be cancelled/ suspended if the Permit holder-

• Uses/causes/allows a vehicle to be used in contravention to the provisions of these Rules/Act.

• Ceases to own the vehicle covered by the Permit.

• Obtained the Permit fraudulently or by misrepresenting.

• Acquires citizenship of any foreign country.

11. Appeals can be made by any aggrieved person against the order of the jurisdictional Authority within 30 days from the date of order to the State Transport Appellate Tribunal.

12. Exemptions:

• The conditions prescribed in Rules 82 to 85-A of the Central Motor Vehicles Rules, 1989 will not apply to the Permit under these rules.

• Permit issued under the Motor Vehicles (All India Permit for Tourist Transport Operators) Rules, 1993 and the All India Tourist Vehicles (Authorisation or Permit) Rules, 2021 will continue to be in force during their validity period as if they were issued under these rules.

New permit rules:Now, tourist vehicles can ferry individual passengers too

Lucknow: the new all-india tourist permit rules that became effective from april 1 have allowed tourist vehicles to transport passengers individually also and not necessarily in a group apart from enabling them to deposit the tax online centrally rather than pay the same individually to the states concerned on the borders.

The new provisions named ‘The All India Tourist Vehicles (Authorisation or Permit) Rules, 2021’ may, however, take some time to be fully operational in UP, like in most other states, with the National Informatics Centre (NIC) developing the requisite system.

“The new all-India permits rules have been notified coming into effect from April 1 but it may take some time for the new system to be fully operational before the NIC in Delhi makes necessary changes in the software,” transport commissioner Dheeraj Sahu said. The new rules, he said, had several important provisions to benefit transporters engaged in the tourism sector.

The most striking feature of the new rules, according to another senior transport official, is that now any transporter with an all-India tourist permit can freely take passengers individually from different locations to different destinations. “Though the same has not been explained in as many words, its interpretation means the same,” he claimed.

Till now, a transporter could ferry tourists only in a group and not individually after obtaining a contract carriage permit that would be valid for the specified routes and for the specified number of days. “But now they can get permits on an annual basis and operate on any route across the country taking passengers from and dropping at different points,” said the officials.

The rules themselves define the term ‘authorisation’ granted by the transport authority to enable tourist vehicles operator/ owner to ply tourist vehicles throughout the territory of India subject to the payment of taxes or fees, if any, levied by the state or Union territory through which it plies.

Defining the scope and validity of authorisation or permit, the rules clarify the first authorization/ permit “shall be valid throughout India” and second the authorization/permit “shall be used for the transport of passengers individually or in a group, along with their personal luggage”.

According to the rules any transporter can submit application along with the prescribed fee for the all-India tourist permit electronically through the Ministry of Road Transport and Highways’ website https://parivahan.gov.in/parivahan/.

Liberalising the permit obtaining process the rules make it binding on the Transport Authority to issue the authorisation or permit within a period of thirty days from the date of receipt of application.

“If no decision is taken by the Transport Authority within thirty days of receipt of the application, the authorisation or permit shall be deemed to have been granted and generated through electronic system,” rules say.

The rules also provide that permit shall not be granted to a tourist vehicle after the completion of twelve years from the date of first registration of the vehicle but in case of a diesel vehicles registered in the National Capital Territory (NCT) of Delhi, permit this duration has been further curtailed to 10 years only.

Also, the tourist vehicles which have been granted permit are required under these rules to prominently display the words ‘All India Tourist Permit’ on the rear left side of the vehicle in white letters in blue background along with the validity of the permit.

Although the new policy’s stated objective is to promote the tourism and the transport sectors by encouraging transporters to buy and ply more tourist vehicles, the UP State Road Transport Corporation (UPSRTC has its own apprehensions with regard to certain provisions.

“The provision allowing tourist vehicles to transport passengers individually will finish the sanctity of nationalized routes and eat into the revenue of country’s all state transport undertakings, including the UPSRTC because now transporters can get stage carriage permits to transport tourists individually even on the nationalized routes that are otherwise reserved exclusively for STUs,” a senior UPSRTC official pointed out.

Why the Kerala transport body has challenged Centre’s new permit rules for tourist vehicles

Here is a look at how a new permit rule under the Union law could change the transport industry, and why Kerala is opposing it.

The state-owned Kerala State Road Transport Corporation (KSRTC) has moved the High Court, challenging the legal validity of the Centre’s All India Tourist Vehicles (Permit) Rules, 2023, which came into effect from May this year. On November 29, the Kerala State Transport Authority cancelled an All-India Tourist Permit (AITP) invoking powers vested with it under the Motor Vehicle Act, 1988.

Contract carriage and stage carriage

In Kerala, bus permits are granted by the respective Regional Transport Authorities in various districts, under Section 72 of the Motor Vehicles Act, 1988. The Act provides for two types of permits for buses — contract carriage and stage carriage.

A contract carriage is a vehicle/bus hired by a passenger or groups of passengers to go from one point to another, regardless of the route, and without stopping to pick up or drop off passengers along the way. Tourist buses in Kerala mainly operate under this permit.

On the other hand, a stage carriage bus runs on a specific route with the fare fixed by the government. A stage carriage runs as a regular bus service, where the entire route is broken into various specified stages till the destination point. KSRTC comes under the state carriage category.

All India Tourist Permit

The central government earlier this year framed the All India Tourist Vehicles (Permit) Rules, 2023. This all-India permit enables a tourist vehicle operator to ply throughout the country on the strength of a permit fee paid under Rule 5. This fee would be distributed among the states and the Union Government under a sharing formula.

Kerala is opposed to this All-India permit, though it is also a beneficiary of this fee-sharing formula.

Earlier, tourist bus permits under Motor Vehicles (All India Permit for Tourist Transport Operators) Rules, 1993. The 2023 Rules have simplified the granting of the permit, and by obtaining a permit from one state, the operator can use their vehicle throughout India.

As per the rule 6 (2) of permit regulations 2023, an operator with AITP can enter into individual contracts with passengers and therefore can pick and drop them at different points en route. This in a way allows a tourist permit holder to operate like a stage carriage, whereas in Kerala, tourist vehicles operate as contract carriages. The changed system can eat into the revenue of state carriages.

Kerala’s arguments

The state government has challenged the rules that allow a tourist vehicle to work as a state carriage, stating that they go against the provisions of the Motor Vehicles Act, 1988 and several Supreme Court verdicts. It has demanded that these rules be struck down.

The flashpoint

Many tourist vehicle operators have obtained the All-India Tourist Permit after the central law came into effect. But the issue heated up in Kerala after a bus operator named Robin Gireesh, with AITP, started operating an inter-state bus from Pathanamthitta to Coimbatore, with many stops enroute. The service was received well by passengers, but KSRTC, which has dominance in the inter-state sector, objected to it.

The Motor Vehicles Department (MVD) stepped in, slapping fines on the bus in many cities. The Tamil Nadu MVD also imposed a fine on the Robin bus, and its owner alleged this was at the behest of Kerala. The bus owner continued the service for a few more days, triggering debate over the new permit norms. The MVD suspended its permit on November 29. The operator then moved the HC, with KSRTC impleaded in the case. The court has orally raised doubts about challenging the new permit rules.

The worry for Kerala

Kerala’s problem is that if private operators with AITPs start operating like a regular bus service, it would hit the revenue of the state transport entity, already running under huge losses.

The ailing KSRTC depends upon revenue from long-distance intra-state and inter-state service to fill its fast-shrinking coffers. The state government in the last two-and-a-half years has paid Rs 4,833 crore for the KSRTC to meet its salary and pension bills. The state has banned private operators from several routes in Kerala, under the norms of nationalisation, to help the KSRTC, but at the cost of passenger facilities. AITP-holders, with brand new vehicles, have no legal hindrance to operate on the nationalised routes.

Why KSRTC is in dire straits

Kerala’s public transport system has been shrinking over the years, due to lack of modernisation of the KSRTC network and the increasing number of private vehicles in the state.

A national family health survey (NFHS-5) in 2022 had found that about one in four families in the state have a car, while the national average is only 7.5 per cent. The figure of private stage carriers has come down to 8,000 from 20,000 a decade back. Meanwhile the KSRTC, which has 5000-odd buses, is operating less than 4,000 buses due to its financial crisis.

Tourists vehicles can now apply for All-India permit through online portal

According to the Ministry of Road Transport & Highways, the permit will be issued, after the submission of relevant documents and fees within 30 days of submission of such applications and the new set of rules will be applicable from April 1.

In a bid to promote tourism and grow state revenues, the Ministry of Road Transport and Highways has announced a new scheme, under which any tourist vehicle operator may apply for an "All India Tourist Authorisation/Permit" through online mode.

The ministry also informed that a new set of rules will be known as, All India Tourist Vehicles Authorisation and Permit Rules, 2021 which has been published vide GSR 166 (E) dated March 10 and will be applicable from April 1.

However, all existing permits shall continue to be in force during their validity.

"The new rules for permits are expected to go a long way in promoting tourism across the states in India, while simultaneously, growing the revenue of state governments. The step was discussed in the 39th and 40th Transport Development Council meetings and was appreciated by participants from the states. The rules come even as the Ministry is in the pursuit of providing seamless movement to tourist passenger vehicles, after the success of goods carriage vehicles under the National Permit Regime," read the release.

The scheme allows flexibility in the form of authorisation/permit being granted, for a period of three months or its multiples thereof, not exceeding three years at a time. This provision has been incorporated keeping in mind those areas of our country where there is a limited season of tourism and also for those operators who have limited financial capacity.

It will also consolidate a central database and fees of all such authorisation/permits, which might give a sense of tourist movements, scope for improvement, promotion of tourism.

The Supreme Court directed the Tamil Nadu government authorities on Tuesday to allow All India Tourist Permit (AITP) vehicles to pass through the state without any hindrance or obstruction. A bench of Justices B V Nagarathna and Ujjal Bhuyan issued a notice to the Tamil Nadu government and state transport authorities on a plea filed by K R Suresh Kumar and others, and sought their responses by August 12. The petitioners, inter-state bus operators who possess the AITP, have sought quashing and setting aside of the state government's directives dated November 6, 2023 and June 18, calling for compulsory registration of all buses registered in other states with the regional transport authorities in Tamil Nadu to enable plying within the state. Draft notification issued to supersede the All India tourist vehicle ( Authorisation or Permit) Rules, 2021

The Ministry of Road Transport and Highways (MoRTH) has issued a draft notification G.S.R 815(E) on 11 November 2022 to supersede the All India Tourist Vehicle (Authorisation or Permit) Rules, 2021.

The rules notified in 2021 provided a significant boost to the tourism sector in India by streamlining and simplifying the permit regime for tourist vehicles.

Now, with the proposed All India Tourist Vehicles (Permit) Rules, 2022, the tourist permit regime is proposed to be further streamlined and strengthened.

The key features of the proposed rules are as follows:

1.To simplify the procedure for All India Permit applicants and to reduce compliance burden, the provision of authorization and All India Tourist Permit has been made independent of each other.

2.More categories of tourist vehicles, with lesser permit fees for lesser capacity vehicles (less than ten) have been proposed. This is expected to provide considerable financial relief to smaller tourist operators having smaller vehicles with lower seating capacity as they will now be required to pay lower fees commensurate with the seating capacity of their vehicle(s).

3.To promote deployment of electric vehicles in large numbers a streamlined regulatory ecosystem at no cost to the operator(s) has been proposed.
