  Annex 1  Important Tips for online COVA visa form filling

(1) Please carefully read the prompts and requirements of the COVA form system, and complete the entries of the visa application COVA online form step by step, making sure that the information is true, accurate and complete. Please note: Once the application form has been submitted, it cannot be modified in any way.

(2) The " location " option  for submitting the visa application should be in line with the consular jurisdiction.

(3) Basic personal information. Surname, given names, gender, date of birth, nationality, passport number, passport type, etc. must be exactly the same as those on the passport information page, otherwise your visa application will be returned.

(4) If you were born in China (including Hong Kong, Macao and Taiwan), please note:

1. Application form 1.1D The Chinese name (if applicable) must be entered in Chinese with the Chinese character input method, please do not fill in "Chinese", "Chinese", etc.

2. In the application form 1.6G, select "Yes" for "former nationality", and then select the nationality information.

3. Item 1.6H of the application form is required. If the applicant is applying for a Chinese visa for the first time, this entry will be automatically generated during the form filling process; but if the applicant has previously applied for a Chinese visa, this entry will not be displayed when filling in the online form, and the form must be printed out and supplemented by hand-written Chinese name and other information. This Item cannot be empty.

(5) Fill in the work experience and educational background

1. Please fill in the work experience in the past 5 years.

2. The “position” and “duty” of the application form 3.2D and 3.2E must be filled in completely.

3. Please fill in the highest diploma/degree in 4.1 , and the diploma/degree and major in 4.1B and 4.1C must be completed.

(6) Completely fill in each address

The address of the spouse in 5.5A of the application form must fill in the address of the current location, not the address of the place of birth. The address must be filled in completely, including street, city, state, and country.

(7) If you choose "not applicable" for any entry in the form, you need to state the reason for “not applicable”.

(8) Printing and signing. After completing the COVA online form filling, you must print out a full set of application forms, including the "Confirmation of Online Visa application" and "Visa Application Form of the People's Republic of China" (depending on the individual filling situation, a total of 8 to 9 pages will be generated). All the pages of the forms must be printed to turn in, the signature and date on the Confirmation Page and the 8th page of Visa Application Form of the People's Republic of China must be handwritten by the applicant him/herself. Visa applicant under the age of 18 is signed by their guardian, and meanwhile add a handwritten signature in the "For person filling in the application on the applicant’s behalf".

(1) Personal information of the invitee: name, gender, date of birth, passport number, etc.

(2) Information about the invitee’s visit to China: reason for coming to China, date of arrival and departure, place of visit, relationship with the inviting unit or inviter, who will pay for the travel, etc.

(3) Inviting party information: inviting party name, address, tel e phone number, official seal, legal representative or inviter’s signature, date, etc. (the information must be included in the text of the invitation letter)

II.Process of Visa Application

The  consular jurisdiction   of the Embassy  of the People ’ s Republic of China   includes : Washington D . C . , Delaware, Idaho, Kentucky, Maryland, Montana, Nebraska, North Carolina, North Dakota, South Carolina, South Dakota, Tennessee, Utah, Virginia, West Virginia, Wyoming, Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, Oklahoma, Texas, Puerto Rico.. Please confirm that the applicant lives in the above-mentioned states before submitting the visa application.

(1)Visa applicants   need to   log on   to   the website   “ China Online Visa Application (COVA) ”   to fill in the COVA   forms .

After completing the COVA forms as required, please   make sure to  print the full set of COVA forms (8-9 pages)  and  sign   on the Confirmation Page and the 8 th   page .   If the COVA forms   are   not prepared   as guided, the application will not be accepted.

(2)   The physical application documents   can be submitted to the Visa Office within the office hours   by the visa applicant or by an agent .

(3)  In addition to the printed   and   signed   COVA forms, visa applicants also need to prepare the physical   Required Documents (include   "A.Basic Documents"   and   "B.General Documents")    to   submit   on-site   to   the   Visa   Office. If the physical documents   do not meet the requirements   or not sufficient, the application may be returned, and the applicant   may need to fill in the COVA forms  again .

(4) Please check all the information on the visa is correct when picking up. If there is any inaccuracy, please tell the staff immediate ly in case inconvenience brought by the incorrect information. Credit card (Master or Visa card only), money order or cashier's check are accepted for on-site pick-up.

China Tourist Visa (L)

Most travelers to China are required to get a China tourist visa, L visa for short, which allows them to travel freely in most parts of China as tourists, assuming that they do not qualify under the  visa-free policies of China . Passports, application form, and documents showing the itinerary or an invitation letter from China are the essential application documents.  

In most cases, a tourist can get a single entry L visa with a stay duration of 30 days. UK, US, Canadian, Brazil and Argentine citizens are able to get a 10-year China tourist visa with multiple entries. If travelling with an organized tour group, you might not have an individual visa in your passport.  Instead, the tour group will be issued a group tour visa bearing all the members' names. In such situations supply your details to the travel agency beforehand and you will have no further concerns.

If travelling independently, you need to handle visa affairs on your own. The process is not complicated if you follow the guidelines below.  

China Tourist Visa Requirements & Documents

1. passport.

- Your passport  with at least 6 months remaining validity and available blank pages, and a photocopy of passport's data page.  

2. Application Form

- One accurately completed China Visa Application Form. Please fill in every column of the application form. If the application form is not filled out truthfully, completely and legibly, there could be a delay in processing or refusal of the application.  

3. Recent Photo

- A recent passport-size color photo with white background.  

4. Round-trip Tickets Plus Hotel Bookings or Invitation Letter from China

- Documents showing the itinerary including proof of round trip tickets booking and proof of hotel reservation. - Or, if you are being invited to China, you can submit an invitation letter issued by the inviter, whether it's an entity or individual, with following information: a. Information on the applicant, including full name, gender, and date of birth. b. Information on the planned visit, including arrival and departure dates, place(s) of visit. c. Information on the inviter, including name, contact number, address, official stamp, and signature of the legal representative of the entity or the inviting individual.  

5. Other Supporting Documents

a. For those not applying in their country of citizenship, a proof of legal stay or residence status is required. b. In some cases, applicants may need to submit a certification letter from the employer of the applicant with details as follows: name and contact number of the employer, the applicant's income statement, or original copy of recent 6-month bank statement of the applicant. c. Applicants who intend to travel to Tibet must obtain a Tibet Travel Permit , which can be obtained from Tourism Bureau of Tibet Autonomous Region by travel agencies.

How to Get a Chinese Tourist Visa

After preparing all the required documents, make an appointment with Chinese embassies, consulates, or a Chinese Visa Application Center (CVASC) if there are any in your country to submit the application. Generally, applicants aged 14-70 need to go in person. If you don't need to go personally, you can entrust someone else, such as a travel agency or a visa agency to act on your behalf. Applications by mails are not accepted and will be refused at most Chinese embassies, consulates or CVASCs. But the mail-back service is available in more cases.   

Processing Time

It normally takes 4 working days for processing a China travel visa. For express service, an additional fee of USD 20 will be charged for two or three working day service. For rush service, an additional fee of USD30 will be charged for same-day service.  

Chinese Tourist Visa Cost

The visa costs vary depending on your nationality and number of entries. However, according to the Visa Fee Abolition Agreement, the nationals of following several countries can get a visa for free, but must pay for express service, rush service or mail service: Pakistan, Maldives, Bulgaria, Bosnia-Herzegovina, Slovakia and Micronesia.     1. Starting from 6 July, 2022, the Chinese Embassy in India will update application procedures and material requirements as follows:

    1.1 Please visit the website of Chinese Visa Application Service Center in New Delhi (https://bio.visaforchina.org/DEL2_EN/) and fill in your detailed and true information on the online application form and the confirmation page. Then make an appointment with your application form number following the system instructions.

1.2 Submit all the required documents in person at the Chinese Visa Center in New Delhi at your appointment time and retain ten fingerprints.

For emergency humanitarian visas other than those mentioned above, such as those for funerals or visits to critically ill relatives in China, the identity documents of the deceased or ill relative (e.g. foreigner's passport, etc.), a death certificate or a certificate of diagnosis, critical illness notice issued by a hospital, proof of kinship, etc. shall be submitted.

    2. The above visas are processed through the Chinese Visa Application Service Center in New Delhi. Please consult with the Visa Center in New Delhi or its website for details of the procedures, requirements, processing time and fees.

A s of March 15,   the Consulate General  of the People’s Republic of China in Kolkata  will adopt the following new measure s for Chinese visa application.

1.  A pplication P rocedures

1.1   Visa applications are   processed  in accordance with respective consular jurisdiction areas  of Chinese Embassy and Consulates-General in India. For applicants who reside in Bihar, Jharkhand, Odisha, Chattisgarh, and West Bengal, their visa applications   are processed by Chinese Consulate-General in Kolkata. For a pplicants who reside in Maharashtra or Karnataka , their visa applications are processed by Chinese Consulate-General in Mumbai. For applicants who reside in areas other than those mentioned above, their visa applications are processed by Chinese Embassy in India.

1.2   For applicants residing in the consular jurisdiction area of   Chinese Consulate General in Kolkata, please submit visa application documents through Chinese Visa Application Service Center  in Kolkata .   First of all, p lease visit the website of Chinese Visa Application Service Center in Kolkata  ( https://www.visaforchina.cn/CCU2_EN ) , f ill out visa application form and confirmation page   online , make an appointment, print out the confirmation page and full form, and sign   name .   Then at the appointment time , s ubmit the application in person with materials ( p lease see Part 2 for material requirements)   at Chinese Visa Application Service Center in Kolkata  and retain ten fingerprints.

1.3   The following applicants can be exempt ed  from fingerprint collection:  those who are  under the age of 14 or over the age of 70; those  who already had   fingerprints collected within the past five years at Chinese Consulate General in Kolkata  or Chinese Visa Application Service Center  in Kolkata   using  the same passport; Applicants with all finger print s uncollectable.

(4) Original and photocopy of the p roof of legal stay , residence, employment or stud y status   or valid visa (applicable to applicants of non-Indian  citizen s )

(1) The invitation letter may be in the form of fax, photocopy or computer printout, but consular officer s  may require the applicant to submit the original invitation letter.   The invitation letter should contain   following information :   i nformation on the applicant (full name, gender, date of birth, etc.) ; i nformation on the visit , such as  purpose of visit, place(s) of intended residence, intended duration of residence, intended arrival and departure dates, relations between the applicant and the inviting entity or individual, financial source for expenditures ; i nformation on the inviting entity or individual (name, contact telephone number, address, official stamp, signature of legal representative or the inviting individual, etc.)

(2) C onsular officer s  may require the applicant to provide other supporting  documents, or require an interview with the applicant.  C onsular officer s  will decide on whether the visa   should be issue d  and on its validity, duration of stay and number of entries in light of specific conditions of the applicant.

(1) Foreign nationals who subject to mutual visa exemption agreements.

(2) Valid permanent resident permit ID card.

(3) Valid residence permits.

(4) Holding valid APEC Business Travel Cards  (please note: To further facilitate business travel, APEC Virtual Cards holders will also be accepted for entry from 1 May 2023. As transitional arrangement, APEC Virtual Card holders who need to apply for a visa before 1 May 2023 will be facilitated by the Embassy, please contact the consular section of the Embassy for details).

(5) Transit Visa Exemption Program.

(6) Hainan visa-free policy; Visa-free policy specified for foreign cruise-group-tour through Shanghai Port; Guangdong visa-free policy specified for foreign tour groups entering from Hong Kong SAR or Macao SAR; visa-free policy specified for foreign tour groups of ASEAN countries entering Guilin, Guangxi province (For details, please contact the immigration inspection authorities of the intended destination).

Following is the list of documents required for China Tourist visa for Indians.

A passport is a document that is required at the time of international travels. It is issued by the government of the country to verify the identity and nationality of the candidate.

The submitted passport must meet the parameters given below

  • It must have minimum two blank pages for the visa stamp.
  • It must be original and genuine.
  • It must be valid for 6 months ahead of the span of stay.
  • It must not be torn, ripped, split, or damaged in any kind of way.

One cannot cross international boundries without the passport. It is considered a criminal offense otherwise.

The photo is provided to the authority so that you can be identified based on the same.

The photographs must be provided as per the given photo specifications

  • It must cover face 70% of the frame.
  • It must have a matt finish.
  • It must be clicked on an all white background.
  • Two copies to be submitted with general photo guidelines.
  • It must be of proper size with dimensions of 35x45 mm (length - 33mm, breadth - 48mm).
  • It must be a recent photograph.
  • The expressions on the face must be neutral, there must not be any kind of smiling of frowning in the photograph.
  • Any kind of glasses must not be worn in the photograph.
  • The hair must be tied back so that the face is clearly visible.
  • The ears must be visible clearly.
  • It must not have any headgear worn apart from religious reasons.
  • It is to be taken care that your teeth do not show in the photograph.

Recent pictures are mandatory as old pictures can cause the authorities to reject your application.

An old passport is a passport that has expired or is completely stamped. In the visa processing, it is required to track the travel history of the applicant.

If available, the old passport must also be provided meeting the given criteria

  • In case required one year multiple entry visa .
  • It must be original and in a good condition to access the required information.

Without the old passport, you cannot get the visa stamp. Professional visa consultation is recommended.

Covering Letter consists of traveler's information, Itenarary, detailed travel Information, trip expense details and your return guarantee to the home country.

The covering letter provided by the visa applicant should be acceptable based on the following guidelines

  • It must mention other details as well as per the Consular's request.
  • It must mention the accommodation details of the applicant.
  • It must mention the person who will be bearing all the expenses during the trip, if not travelling alone.
  • It must specify the traveller's relationship with the fellow travellers if not travelling alone.
  • It must clearly specify the traveller's purpose of visit.
  • It must mention the travel dates as per the invitation letter or the booked flight tickets.
  • It must mention all the details as per the passport.

Covering letter is the first document that is seen by the consular. If the covering letter is not appropriate, it may cause your visa to get rejected as well. Professional visa consultation is recommended.

Bank statement is a document that issued from the bank. This is obtained for the savings bank account to show ratify if you will be able to support your stay in the country.

The Bank statement is a mandatory document and it should meet the following criteria

  • It must be original and obtained for the last 6 months. .
  • It must be original and should have the bank's stamp and signature on every page.

If the Bank Statement doesn't show enough funds or shows irrelevant expenditure, it could lead to visa rejection on financial means. Professional visa consultation is recommended.

A hotel voucher is a ticket provided by the hotel of residence to the customers who are taking an accomodation in the hotel.

It should be submitted as per the following

  • It must be obtained on the Hotel's letterhead and should be provided as proof of accommodation.
  • It must be provided to ratify the purpose of visit and as proof of accommodation as well.

If you are staying in a hotel during your time in another country, a hotel voucher must be provided as proof of accommodation.

An air ticket is a ticket or pass that is possessed by the traveller who is taking a flight for travelling from one location to another.

It is an important document and it should be submitted for the given reason

  • The tickets must be confirmed for the to and fro journey.
  • It must be confirmed for the complete round trip.

An air ticket shows your course of travel and confirms your return to the native country.

It is a document provided by the bank stating the amount of fund in your account.

  • It must be signed by the bank and must be obtained on the bank's letterhead.

Without this, you will not be able to apply for a visa as you will not meet the financial requirements.

Itinerary is a travel document that contains the details of travel schedule of the one who is going on the trip.

  • It must mention the day to day schedule and plans and program while in the country.

Eligibility for getting China Tourist Visa:

In order to be eligible to travel to the country on a visa, you will have to meet the following eligibility criteria.

Be a genuine traveller- You must have a valid and good intention behind travelling to the country.

Eligible to bear all expenses - You must possess sufficient funds to support yourself and any dependents throughout the stay.

As of 10th  June 2024 , the Embassy of the People’s Republic of China in India will adopt the following new measures for Chinese visa application.

1. Application Procedures

1.1 Visa applications are processed in accordance with respective consular jurisdiction areas of Chinese Embassy and Consulates-General in India. For applicants who reside in Bihar, Jharkhand, Odisha, Chattisgarh, and  West Bengal, their visa applications are processed by Chinese Consulate-General in Kolkata. For applicants who reside in Maharashtra or Karnataka, their visa applications are processed by Chinese Consulate-General in Mumbai. For applicants who reside in areas other than those mentioned above, their visa applications are processed by Chinese Embassy in India.  Please check issue place of your passport for confirming the jurisdiction areas.

1.2 For applicants residing in the consular jurisdiction area of Chinese  Consulate in Kolkata , please submit visa application documents through Chinese Visa Application Service Center in Kolkata . First of all, please visit the website of Chinese Visa Application Service Center in  Kolkata https://www.visaforchina.cn/#/nav/quickSelection?visacenterCode=CCU2&request_locale=en_US&site_alias=CCU2_EN&isAuthentication=N   

fill out visa application form and the applicant can do walk in for visa , in between 9:00am to 12:00pm from monday to friday , make an appointment for Authentication only, print out the confirmation page and full form, and sign name. Then at the appointment time, submit the application in person with materials (please see Part 2 for material requirements) at Chinese Visa Application Service Center in Kolkata  and retain ten fingerprints.

1.3 The following applicants can be exempted from fingerprint collection: those who are under the age of 14 or over the age of 70; those who already had fingerprints collected within the past five years at Chinese Embassy in India or Chinese Visa Application Service Center in Kolkata  using the same passport; Applicants with all fingerprints uncollectable.

2. Material Requirements 

2.1 General Documents

(1) Chinese Visa Application Form and Confirmation Page of Online Visa Application.

(2) Original passport still valid for at least 6 months, with 2 or more blank visa pages, and the photocopy of relevant passport pages ; and expired passports within 5 years and the photocopy of relevant passport pages.

(3) Two recently-taken color passport photos (full face, front view and bare head , size: 48mm×33mm , within 6 months).

(4) Original and photocopy of the proof of legal stay, residence, employment or study status or valid visa (applicable to applicants of non-Indian citizens) .

(5)  Covering letter (For details, please check following 2.3  Special Reminder and Other Supplementing Document Requirements  )

2.2 Category Documents

In addition to the general documents in 2.1, the following supporting documents for respective visa categories must be submitted:

(1) Non-regular scheduled flight, chartered flight, private plane must get the Aviation Permit before departure.

(2) Personal or Company's written statement (covering letter with details as follows: basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting / contact company or person).

D  Visa

Personal or Company's written statement (covering letter with details as follows: basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting / contact company or person).

(1) An invitation letter issued by a relevant entity or individual in China. The invitation should contain:

a. Information on the applicant (full name, gender, date of birth, etc.)

b.Information on the planned visit (purpose of visit, arrival and departure dates, place(s) to be visited, relations between the applicant and the inviting entity or individual, financial source for expenditures)

c.Information on the inviting entity or individual (name, contact telephone number, address, official stamp, signature of the legal representative or the inviting individual)

G  Visa

 Personal or Company's written statement (covering letter with details as follows: basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting / contact company or person  if applicable ).

 Personal or Company's written statement (covering letter with details as follows: basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting / contact company or person).

(1) Documents on the commercial activity issued by a trade partner in China, or trade fair invitation relevant entity or individual. The invitation letter should contain:

c.Information on the inviting entity or individual (name, contact telephone number, address, official stamp, signature of the legal representative or the inviting individual).

(2) Personal or company's written statement (covering letter with details as follows: basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting / contact company or person).

(1) An invitation letter issued by a Chinese citizen or a foreign with a Chinese permanent residence permit who lives in China. The invitation letter should contain:

b. Information on the visit ( purpose of visit, intended arrival date, place(s) of intended residence, intended duration of residence, relations between the applicant and the inviting  individual, financial source for expenditures)

c. Information on the inviting individual (name, contact telephone number, address, signature etc.)

(2) Personal written statement (covering letter with details as follows: basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting person).

Holders of Q1 Visa shall, within 30 days from the date of their entry, apply to the exit/entry administrations of public security organs under local people's governments at or above the county level in the proposed places of residence for foreigners' residence permits.

(1) An invitation letter issued by a Chinese citizen or a foreign citizen with a Chinese permanent residence permit who lives in China. The invitation letter should contain:

b. Information on the visit (purpose of visit, arrival and departure dates, place(s) to be visited, relations between the applicant and the inviting individual, financial source for expenditures)

c. Information on the inviting individual (name, contact number, address, signature etc.)

(2) Personal written statement (covering letter with details as follows: basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting person).

Holders of S1 Visa shall, within 30 days from the date of their entry, apply to the exit/entry administrations of public security organs under local people's governments at or above the county level in the proposed places of residence for foreigners' residence permits.

b.Original Permit for Foreign Experts Working in China issued by the State Bureau of Foreign Experts.

c.Notification Letter of Foreigner's Work Permit in the People's Republic of China issued by the State Bureau of Foreign Experts.

d.Registration Certificate of Resident Representative Offices of Enterprises of Foreign Countries(regions) issued by Chinese authorities of industrial and commercial administration.

e. An original approval document for commercial performances issued by the Chinese government authorities for cultural affairs. If the performance period is 90 days or less, original Approval of Short-Term Employment for Foreigners Working in P.R. China is needed.

f.Original Letter of Invitation to Foreigners for Offshore Petroleum Operations in China issued by China National Offshore Oil Corporation;

(2) Personal written statement (covering letter with details as follows:   basic information of the applicant, visiting purpose, place to visit, name, address and contact number of the inviting / contact company or person).

A holder of category Z visa must apply for a residence permit at the local public security authorities within 30 days of entry into China unless the Duration of Each Stay on the visa is marked as 30 days.

Other Important Reminder

(1) The applicant should guarantee that all information provided in the application is true and correct. Any false, misleading or incomplete information may result in denial of the visa or refusal of entry into China.

(3)  The invitation letter may be in the form of fax, photocopy or computer printout, but consular officers may require the applicant to submit the original invitation letter.

(3) Consular officers may require the applicant to provide other supporting documents, or require an interview with the applicant.  C onsular officer s  will decide on whether or not to issue the visa and on its validity, duration of stay and number of entries in light of specific conditions of the applicant.

3. Cases Not Needing To Apply For A New Visa

(1) Foreign nationals who subject to mutual visa exemption agreements; 

(2) Valid permanent resident permit ID card;

(3) Valid residence permits;

(4) Holding valid APEC Business Travel Cards  (please note: To further facilitate business travel, APEC Virtual Cards holders will also be accepted for entry from 1 May 2023. As transitional arrangement, APEC Virtual Card holders who need to apply for a visa before 1 May 2023 will be facilitated by the Embassy, please contact the consular section of the Embassy for details);

(5)  Transit Visa Exemption Program.

(6)  Hainan visa-free policy; Visa-free policy specified for foreign cruise-group-tour through Shanghai port; Guangdong visa-free policy specified for foreign tour groups entering from Hong Kong SAR or Macao SAR; visa-free policy specified for foreign tour groups of ASEAN countries entering Guilin, Guangxi province (For details, please contact the immigration inspection authorities of the intended destination).

"We have been proposed to have a visa-on-arrival. We are giving very serious consideration," Tien Chung-kwang stated, reflecting Taiwan's proactive stance on facilitating tourism and business travel from India.

When the Indian government initiated "Look East Policy" in early 1991, Taiwan and India started to approach each other and loosen visa restrictions.

This development comes after Taiwan's Deputy Foreign Minister strongly rejected China's objection to the recent exchange of messages between Taiwan President Lai Ching Te and Prime Minister Narendra Modi, after the latter's election win.

"I am sure Modi ji and our President will not be intimidated by that reaction," the Deputy Foreign Minister of Taiwan said.

The Chinese Embassy in India recently reiterated that Taiwan is an "inalienable part" of the territory of China.

The embassy's spokesperson further emphasised that the one-China is a universally recognised norm in international relations and a prevailing consensus in the international community.

The India-Taiwan economic partnership has grown significantly in recent years. Taiwan has considered India as a critical partner under its 'New Southbound Policy', and both countries have also signed a migration agreement to allow Indian workers to be employed in Taiwanese industries.

Lai Ching-te, in a stern warning to China, called on Beijing to stop intimidating the island nation, over which China continues to make its claim. (ANI)

A. STATUTORY NUMBERS FOR PREFERENCE IMMIGRANT VISAS

This bulletin summarizes the availability of immigrant numbers during July  for: “Final Action Dates” and “Dates for Filing Applications,” indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center.

Unless otherwise indicated on the U.S. Citizenship and Immigration Services (USCIS) website at  www.uscis.gov/visabulletininfo , individuals seeking to file applications for adjustment of status with USCIS must use the “Final Action Dates” charts below for determining when they can file such applications. When USCIS determines that there are more immigrant visas available for the fiscal year than there are known applicants for such visas, USCIS will state on its website that applicants may instead use the “Dates for Filing Visa Applications” charts in this Bulletin. 

1.  Procedures for determining dates. Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; USCIS reports applicants for adjustment of status. Allocations in the charts below were made, to the extent possible, in chronological order of reported priority dates, for demand received by June 5th . If not all demand could be satisfied, the category or foreign state in which demand was excessive was deemed oversubscribed. The final action date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. If it becomes necessary during the monthly allocation process to retrogress a final action date, supplemental requests for numbers will be honored only if the priority date falls within the new final action date announced in this bulletin. If at any time an annual limit were reached, it would be necessary to immediately make the preference category “unavailable”, and no further requests for numbers would be honored.

2.  The fiscal year 2024 limit for family-sponsored preference immigrants determined in accordance with Section 201 of the Immigration and Nationality Act (INA) is 226,000.  The worldwide level for annual employment-based preference immigrants is at least 140,000.  Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620.  The dependent area limit is set at 2%, or 7,320.

3.  INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa issuances will exceed the per-country limit. These provisions apply at present to the following oversubscribed chargeability areas:  CHINA-mainland born, INDIA, MEXICO, and PHILIPPINES. 

4.  Section 203(a) of the INA prescribes preference classes for allotment of Family-sponsored immigrant visas as follows: 

FAMILY-SPONSORED PREFERENCES

First : ( F1 ) Unmarried Sons and Daughters of U.S. Citizens:  23,400 plus any numbers not required for fourth preference.

Second : Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents:  114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, plus any unused first preference numbers:

A. ( F2A ) Spouses and Children of Permanent Residents:  77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;

B. ( F2B ) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents:  23% of the overall second preference limitation.

Third : ( F3 ) Married Sons and Daughters of U.S. Citizens:  23,400, plus any numbers not required by first and second preferences.

Fourth : ( F4 ) Brothers and Sisters of Adult U.S. Citizens:  65,000, plus any numbers not required by first three preferences.

A.   FINAL ACTION DATES FOR FAMILY-SPONSORED PREFERENCE CASES

On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); "C" means current, i.e., numbers are authorized for issuance to all qualified applicants; and "U" means unauthorized, i.e., numbers are not authorized for issuance. (NOTE: Numbers are authorized for issuance only for applicants whose priority date is earlier than the final action date listed below.)

For July, F2A numbers  EXEMPT from per-country limit  are authorized for issuance to applicants from all countries with priority dates  earlier  than 01FEB21. F2A numbers  SUBJECT to per-country limit  are authorized for issuance to applicants chargeable to all countries EXCEPT MEXICO , with priority dates beginning 01FEB21 and earlier than 15NOV21. All F2A numbers provided for MEXICO are exempt from the per-country limit.

B.  DATES FOR FILING FAMILY-SPONSORED VISA APPLICATIONS

The chart below reflects dates for filing visa applications within a timeframe justifying immediate action in the application process. Applicants for immigrant visas who have a priority date earlier than the application date in the chart below may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions. The application date for an oversubscribed category is the priority date of the first applicant who cannot submit documentation to the National Visa Center for an immigrant visa. If a category is designated “current,” all applicants in the relevant category may file applications, regardless of priority date.

The “C” listing indicates that the category is current, and that applications may be filed regardless of the applicant’s priority date. The listing of a date for any category indicates that only applicants with a priority date which is earlier than the listed date may file their application.

Visit www.uscis.gov/visabulletininfo for information on whether USCIS has determined that this chart can be used (in lieu of the chart in paragraph 4.A.) this month for filing applications for adjustment of status with USCIS. 

5.  Section 203(b) of the INA prescribes preference classes for allotment of Employment-based immigrant visas as follows: 

EMPLOYMENT-BASED PREFERENCES

First :  Priority Workers:  28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.

Second :  Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability:  28.6% of the worldwide employment-based preference level, plus any numbers not required by first preference.

Third :  Skilled Workers, Professionals, and Other Workers:  28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to "*Other Workers".

Fourth :  Certain Special Immigrants:  7.1% of the worldwide level.

Fifth :  Employment Creation:  7.1% of the worldwide level, of which 32% are reserved as follows: 20% reserved for qualified immigrants who invest in a rural area; 10% reserved for qualified immigrants who invest in a high unemployment area; and 2% reserved for qualified immigrants who invest in infrastructure projects. The remaining 68% are unreserved and are allotted for all other qualified immigrants.

A.  FINAL ACTION DATES FOR EMPLOYMENT-BASED PREFERENCE CASES

*Employment Third Preference Other Workers Category: Section 203(e) of the Nicaraguan and Central American Relief Act (NACARA) passed by Congress in November 1997, as amended by Section 1(e) of Pub. L. 105-139, provides that once the Employment Third Preference Other Worker (EW) cut-off date has reached the priority date of the latest EW petition approved prior to November 19, 1997, the 10,000 EW numbers available for a fiscal year are to be reduced by up to 5,000 annually beginning in the following fiscal year. This reduction is to be made for as long as necessary to offset adjustments under the NACARA program. Since the EW final action date reached November 19, 1997 during Fiscal Year 2001, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002. For Fiscal Year 2024 this reduction will be limited to approximately 150.

B.  DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS

The chart below reflects dates for filing visa applications within a timeframe justifying immediate action in the application process. Applicants for immigrant visas who have a priority date earlier than the application date in the chart may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions. The application date for an oversubscribed category is the priority date of the first applicant who cannot submit documentation to the National Visa Center for an immigrant visa. If a category is designated “current,” all applicants in the relevant category may file, regardless of priority date.

B .   DIVERSITY IMMIGRANT (DV) CATEGORY FOR THE MONTH OF JULY

Section 203(c) of the INA provides up to 55,000 immigrant visas each fiscal year to permit additional immigration opportunities for persons from countries with low admissions during the previous five years.  The NACARA stipulates that beginning with DV-99, and for as long as necessary, up to 5,000 of the 55,000 annually allocated diversity visas will be made available for use under the NACARA program.  Visa numbers made available to NACARA applicants in FY 2023 will result in reduction of the DV-2024 annual limit to approximately 54,850.  Section 5104 of the National Defense Authorization Act (NDAA) for Fiscal Year 2024 amended the NACARA’s provisions on the Diversity Visa program such that the number of visas made available under the NDAA will be deducted from the 55,000 DVs annually allocated.  These amendments will not impact the number of diversity visas available until FY 2025.  DVs are divided among six geographic regions. No one country can receive more than seven percent of the available diversity visas in any one year.

For July , immigrant numbers in the DV category are available to qualified DV-2024 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers  BELOW  the specified allocation cut-off number:

Entitlement to immigrant status in the DV category lasts only through the end of the fiscal (visa) year for which the applicant is selected in the lottery. The year of entitlement for all applicants registered for the DV-2024 program ends as of September 30, 2024. DV visas may not be issued to DV-2024 applicants after that date. Similarly, spouses and children accompanying or following to join DV-2024 principals are only entitled to derivative DV status until September 30, 2024. DV visa availability through the very end of FY-2024 cannot be taken for granted. Numbers could be exhausted prior to September 30.

C.   THE DIVERSITY (DV) IMMIGRANT CATEGORY RANK CUT-OFFS WHICH WILL APPLY IN AUGUST

For August , immigrant numbers in the DV category are available to qualified DV-2024 applicants chargeable to all regions/eligible countries as follows. When an allocation cut-off number is shown, visas are available only for applicants with DV regional lottery rank numbers  BELOW  the specified allocation cut-off number:

D.   RETROGRESSION IN THE EMPLOYMENT-BASED THIRD (EB-3) PREFERENCE CATEGORY

As readers were informed was possible in Item D of the June 2024 Visa Bulletin , it has become necessary to retrogress the worldwide EB-3 final action date (including Mexico and Philippines) effective in July.  Given continued high demand and number use in this category, it will likely be necessary to either further retrogress the final action date or make the category “Unavailable” in August. This situation will be continually monitored, and any necessary adjustments will be made accordingly. 

E.   U.S. GOVERNMENT EMPLOYEE SPECIAL IMMIGRANT VISAS (SIVs)

The National Defense Authorization Act (NDAA) for Fiscal Year 2024, signed into law on December 22, 2023, may affect certain current and former employees of the U.S. Government abroad applying for SIVs or adjustment of status, as described in section 101(a)(27)(D) of the INA.  This does not affect certain Iraqis and Afghans applying for SQ and SI SIVs.  Applicants should contact the consular section at which they filed their Form DS‑1884 for further information on the impact of that law on their case.
