Refund: ABTA delayed in deciding who was liable for the axed cruise

Tony Hetherington is Financial Mail on Sunday's ace investigator, fighting readers corners, revealing the truth that lies behind closed doors and winning victories for those who have been left out-of-pocket. Find out how to contact him below. 

P.W. writes:  We booked through JTA Travel for a trip with Cruise and Maritime Voyages. Because of the pandemic, the trip was cancelled, and we agreed with JTA Travel to rebook for a later date, but then Cruise and Maritime ceased trading. 

We were told we would get a full refund of the £2,670 cost as customers were protected by the Association of British Travel Agents (ABTA). 

However, ABTA itself says JTA Travel must repay us, so we are caught between the two.

Tony Hetherington replies:  It is never nice to be trapped between two businesses, with each agreeing you are entitled to a refund, but at the same time blaming each other for failing to fork out the cash. 

What this comes down to is the question of whether JTA Travel was acting as a travel agent or a tour operator. If it was just a booking agent, then ABTA's compensation scheme would cover your losses.

But if JTA Travel went beyond this and organised far more than just your cruise booking, then it could be classed as a tour operator, and since it is still in business from its Birmingham base, it would be responsible for refunding you.

ABTA's verdict was that JTA Travel should foot the bill. It explained: 'Our decision was based upon the travel documentation which confirmed that JTA were acting as the tour operator, and as such they retain full liability for your travel arrangements or any refund due to you.' 

Not surprisingly, JTA Travel was unhappy with this. It would not pay up, and said it was consulting its lawyers. And all it would tell me was that it was having 'ongoing conversations' with ABTA. It refused to accept your version of events, but at the same time refused to say what was wrong with what you told me. 

Surely though, ABTA has the power to order JTA Travel to pay up or face expulsion and the loss of the valuable reassurance that ABTA membership offers its customers? This is a simple question, but trying to get a simple answer from ABTA was like trying to nail jelly to the wall. 

ABTA pointed me towards its code of conduct. This runs to 16 pages with two further documents on top, and a 47-page guide which is where I eventually found that ABTA expects refunds to be issued within 14 days, and certainly no later than 30 days. 

But then ABTA pulled the rug out from under its own feet, admitting to me that despite ruling that JTA Travel was a tour operator and should issue a refund, in fact it was still in discussions with the Birmingham business.

Holidaymakers rely heavily on ABTA to regulate its members and, if necessary, enforce its rulings. Failing to enforce its decisions, and then having second thoughts, is not reassuring. 

ABTA gave you the clear impression it had made up its mind and ordered JTA Travel to repay you. But it beat about the bush when I asked about its enforcement powers. And finally it went back to chewing this over with JTA Travel, just as it was doing months ago. 

Then, at the very last minute, along has come an unexpected fairy godmother in the shape of Tesco Bank. You paid for the cruise with your Tesco Bank card, and strictly speaking, you are far too late to ask the bank to snatch back the cash. But this is exactly what the bank has done. 

Because you have been messed about by both ABTA and JTA Travel, Tesco Bank is going to credit your card with the full £2,670. 

The bank will then fight it out with JTA Travel, and you have told me you will help with all the evidence that is needed. Whoever wins that fight, it strikes me that ABTA will be the real loser in terms of its reputation. 

Why all this hassle to axe bank's insurance? 

L.B. writes: For many years we have had a Lloyds Bank current account which came with free insurance for mobile phone, travel, AA breakdown and card loss. 

We have never used the insurance, so when Lloyds said it intended to charge £14.95 a month in future, we decided to cancel the cover. 

However, our branch says we need to close the account and open a new one, and that first we must make an appointment to discuss this with a consultant.

Tony Hetherington replies:  According to Lloyds, the insurance can be cancelled via internet banking, which you do not have, or by telephone, though you found the number was permanently engaged. The third option was cancellation of the insurance by going to your branch, but when you did this the manager and staff said they could not simply delete the insurance. You would have to have a meeting with a 'consultant', who I imagine is a salesperson. 

I asked the bank to explain, and a spokesman told me you could switch to a Classic Account with the same sort code and account number, so all your direct debits and similar arrangements would be unchanged. 

But you still had to make an appointment to see a consultant, even though the bank itself was shifting the goalposts and a meeting might involve time off work. 

The bank's complaints department has now credited your account with £30 by way of saying sorry for poor service, and if you wish to stay with Lloyds, staff say they will arrange to call you rather than expect you to call them.

The brand acquisition is complete and will have a brand new, agent only – user friendly Belleair trade site up and running and ready to take bookings from mid-May.

Malta Specialist trade brand Belleair Holidays has been acquired by Alfendo Limited the parent company of JTA Travel Group . Part of the JTA family, the business will be headed up by senior JTA Travel Group Executive Dave Green , who will also take up the position of Managing Director for the reformed specialist operator. Dave previously held the role of joint Managing Director for the Malta Specialist from 2014-2017, under the previous Holiday Malta Co. Ltd. ownership.

Green commented, “When we heard that Nigel and Steve (Crownshield) had decided to close the business, we were determined that this historic travel brand wouldn’t be allowed to bite the dust. Belleair is a brand that agents have loved for over 40 years as the ‘go to’ operator for the Maltese Islands and beyond, we aim to bring that back, stronger than ever before.

We absolutely know that UK consumers love the Maltese Islands, the diversity of the product and the inclusivity of the warm friendly people. The Islands have a year-round appeal and are located close enough to the UK to go for an action-packed weekend break, a mid-week culture fest, a two-week chill in the sun or even a long stay during the cold UK winter months – which we believe will be very popular next winter, especially against the backdrop of rising costs in the UK.

We aim to make it easy for agents to promote what the Maltese Islands have to offer and will provide a brand-new booking engine that agents can use to make the online booking experience effortless” .

To complement the Malta offering, other launch destinations will include Croatia, Cyprus, Egypt, Greece, Italy, Morocco, Qatar, Tunisia, Turkey.

Agents will be rewarded with highly competitive prices to win customers and will also be able to claim great incentives through the Belleair / JTA Rewards programme.

Green continued, “We have recruited ex-colleagues from the previous Belleair team including Fiona Morgan who joins as Specialist Product Manager and who holds over 20 years’ experience with the operator. Our aim is to recruit and retain experience and specialist knowledge and plan to get Belleair Holidays firing on all cylinders very soon, so we can support our wonderful trade colleagues and partners once again” .

Travelcorp midlands branches join new consortium.

Five of TravelCorp Midlands’ six retail branches have joined The Travel Network Group (TTNG). 

The company’s Toucan Travel branches in Chineham, Tadley and Hook, along with Hart Travel in Fleet and Chatsworth Travel in Chesterfield, have joined TTNG’s Worldchoice proposition. TravelCorp also oversees Elite Escapes in Studley. The business said that by joining TTNG, it aimed to "enhance its offerings and expand its reach within travel".

Rural Messenger named official county newspaper, may come with legal issues

The Reno County Commission approved a motion to switch the official newspaper of Reno County from the Hutchinson News to the Rural Messenger on Wednesday morning at the county courthouse, citing that switching to another publication would save money on newspaper space and legal notices.

Three newspapers bid to become the official periodical: the Ninnescah Valley News (published in Pretty Prairie), The Rural Messenger (published in Haven), and the Hutchinson News (published in Hutchinson). Ninnescah Valley News has a print circulation of 630, and the Rural Messenger circulates 10,300 copies. The Hutchinson News failed to comment on publication numbers.

“I haven’t talked to anyone recently who still has a subscription to the [Hutchinson] news,” said Commissioner Don Bogner.

The commission cited concerns over costs to print in the Hutchinson News, as the corporate-owned paper charges $18.70 per column inch, compared to the Rural Messenger at $8.50, and the Ninnescah Valley News at $3.70.

“While I read and like the Rural Messenger, we’re all worried about costs and budget,” said Commissioner Ron Hirst.

Chairman Daniel Friesen proposed a resolution to authorize the change of the official newspaper to the Rural Messenger if they were to match the Ninnescah Valley News’s rate of cost.

“We would certainly entertain that,” said Anita Stuckey, an owner of the Rural Messenger.

However, the Rural Messenger may not be eligible to become the official paper, as the publication is free, and Kansas statute requires that newspapers must have “general paid circulation on a daily, weekly, monthly or yearly basis in the county,” according to the Kansas Office of Revisor of Statutes (64-101). 

Joey Young, owner of Kansas Publishing Ventures and Publisher of The Clarion, the Harvey County Now, and the Hillsboro Free Press, commented on the issue.

“That seems curious, as the Rural Messenger doesn’t fit the statute to be the official newspaper of the county. The Hutch News and the Ninnescah Valley News fit the statute the way I read it,” said Young. “I’m not entirely certain how the county will give the legal notices to the Rural Messenger legally”

Young also commented on a newspaper that his company manages, the Hillsboro Free Press. The Free Press is a free newspaper that covers Marion County but is not legally allowed to carry legal notices because it is a free publication.

“If a free paper were eligible to be the county newspaper, our Hillsboro Free Press in Marion County would be able to bid on the legals there, but we are not allowed to,” said Young.

Reno County Counselor Patrick Hoffman said that the Rural Messenger fit the Request for Proposal (RFP) and that the publication reported to the county they had paid circulation when they bid.

“We showed everybody the requirements of RFP, and we will double check that they meet the requirements before we make anything official,” said Hoffman.

If the Rural Messenger does not fit the statute or cannot match the pricing of print as the Ninnescah Valley News, the motion passed automatically defaults to the Ninnescah Valley News.
