USDOT Finalizes Important National Regulation to Promote Transit Safety and Protect Transit Workers

WASHINGTON – The Biden-Harris Administration will continue its focus on keeping public transportation the safest mode of surface travel, while increasing safety protections for transit workers. The U.S. Department of Transportation's Federal Transit Administration (FTA) announced a final rule updating FTA's Public Transportation Agency Safety Plans (PTASP) regulation , along with a newly revised National Public Transportation Safety Plan . These major safety updates will make transit systems safer for transit workers and passengers nationwide, while providing workers more input in safety-making decisions through enhanced safety committees.

"Millions of Americans depend on safe, reliable public transportation every year, and transit workers deserve to be safe when they’re delivering this essential service," said U.S. Secretary of Transportation Pete Buttigieg . "These improved safety measures will enhance the safety of public transportation by empowering transit agencies and workers to identify risks, find solutions to mitigate those risks, and ensure the solutions are properly carried out."

The new rule and revised safety plan are the result of months of work by Biden-Harris Administration leaders and in response to dozens of comments filed by stakeholders, including transit agencies.

"The safe operation of public transit is FTA's top priority," said FTA Acting Administrator Veronica Vanterpool . "Today's updates to the National Safety Plan and PTASP regulation reflect our continued commitment, in cooperation with our state and industry partners, that every rider of public transit has a safe and reliable transportation experience."

Public Transportation Agency Safety Plans Update

In the first major update to the PTASP regulation , FTA is increasing frontline transit worker involvement in safety, strengthening communication between frontline transit workers and transit agency management, and requiring the industry to use data to identify and manage safety risk.

The changes apply to more than 700 transit agencies nationwide, including requirements for transit agencies serving areas with a population of 200,000 or more that largely coincide with the most significant increases in reported assaults on transit workers.

Under the Bipartisan Infrastructure Law, impacted transit agencies are required to establish safety committees with equal numbers of frontline transit worker and management representatives to address safety issues. The updated PTASP regulation includes specific requirements for safety committee membership, procedures, and responsibilities to provide frontline workers more input into safety decision-making. 

A safety committee can recommend safety improvement strategies based on the agency’s safety risk reduction program. If approved as part of the larger agency safety plan, transit agencies are required to implement the safety risk mitigations. This includes preventing assaults on transit workers and vehicle-pedestrian collisions.

The new rule also requires safety performance targets be set by agencies.

All applicable transit agencies are also required to incorporate de-escalation training for frontline transit workers and minimize exposure to infectious diseases, consistent with guidance from the Centers for Disease Control and Prevention or a state health authority.

The updated regulation also incorporates the Bipartisan Infrastructure Law requirement that transit agencies serving areas with a population of less than 200,000 develop their safety plans in cooperation with frontline transit worker representatives.

National Safety Plan

Reauthorized under President Biden's Bipartisan Infrastructure Law in November 2021, the National Safety Plan creates a blueprint for transit agencies to adopt stronger safety practices, including mandatory performance measures for transit agencies subject to the PTASP regulation to address assaults on transit workers. 

The updated safety plan also includes best practices, tools, technical assistance, voluntary standards, and other resources for transit agencies to improve their safety performance related to major events, collisions, and injuries. The plan also incorporates Bipartisan Infrastructure Law provisions for risk-based approaches to reducing injuries and fatalities on transit systems.

The updated plan supports the Department's goal of making our transportation systems safer for all, which supports the vision outlined in the National Roadway Safety Strategy . It also builds upon FTA's Bus-to-Person Collision Safety Advisory , which calls on transit agencies to assess this safety concern and consider strategies to reduce these types of collisions that accounted for 15 percent of all transit fatalities between 2008-2021, as reported to the National Transit Database.

The updated National Safety Plan includes 22 performance measures, including eight measures for safety risk reduction programs. Joint labor-management safety committees will now use these measures to set risk reduction performance targets focused on reducing the number and rates of accidents, injuries, and assaults on transit workers.

Air Travel Consumer Report: January 2024 Numbers

WASHINGTON – The U.S. Department of Transportation (DOT) today released its Air Travel Consumer Report (ATCR) on airline operational data compiled for the month of January 2024 for on-time performance, mishandled baggage, and mishandled wheelchairs and scooters. The ATCR is designed to assist consumers with information on the quality of services provided by airlines. 

DOT expects that airlines will operate flights as scheduled and that when they do not, airlines will provide consumers the services consumers have been promised when a flight is canceled or delayed because of an airline issue. After a two-year DOT push to improve the passenger experience, the 10 largest airlines now guarantee meals and free rebooking on the same airline and nine guarantee hotel accommodations. Consumer-friendly information regarding airline commitments to their customers is available on the Department’s Airline Customer Service Dashboard at FlightRights.Gov. DOT also pushed airlines to provide fee-free family seating and rolled out a new family seating dashboard that highlights the airlines that guarantee fee-free family seating, and those of the 10 largest that do not, making it easier for parents to avoid paying junk fees to sit with their children when they fly.

In addition, DOT is improving transportation for individuals with disabilities. In July 2023, DOT finalized a rule which requires airlines to make lavatories on new, single-aisle aircraft more accessible. Then, in February 2024, DOT issued a proposal to address other barriers that Americans who use a wheelchair encounter when it comes to air travel by, among other things, mandating enhanced training for airline employees and contractors who physically assist passenger with disabilities and handle passengers’ wheelchairs.

Further, when necessary, DOT takes enforcement action against airlines and ticket agents that fail to comply with the Department’s aviation consumer protection requirements. In 2023, DOT issued the largest fines in the history of the consumer protection office. This includes a $140 million penalty against Southwest Airlines for failing passengers during the 2022 holiday meltdown. That penalty, which was in addition to over $600 million DOT already ensured was refunded by Southwest to passengers, requires Southwest to establish a $90 million compensation system for future passengers affected by significant delays and cancellations. DOT has helped return more than $3 billion in refunds to travelers since the pandemic began.

Flight Operations

The 560,352 flights operated in January 2024 were 99.56% of the 562,845 flights operated in January 2023. Operated flights in January 2024 were down 0.44% year-over-year from the 562,845 flights operated in January 2023 and down 7.18% month-over-month from 603,756 flights operated in December 2023.

In January 2024, the 10 marketing network carriers reported 582,425 scheduled domestic flights, 22,073 (3.8%) of which were canceled. In December 2023, airlines scheduled 606,218 domestic flights, 2,462 (1.3%) of which were canceled. In January 2023, airlines scheduled 573,877 domestic flights, 11,032 (1.9%) of which were canceled.

On January 6, 2024, the Federal Aviation Administration (FAA) ordered the grounding of Boeing 737 MAX aircraft with a mid-cabin door plug installed operated by U.S. airlines or in U.S. territory. On January 24, 2024, FAA cleared all such aircraft to return to service after each aircraft operator successfully completed a new inspection process approved by the FAA. Alaska Airlines and United Airlines have informed the DOT that the grounding of the 737 MAX9 aircraft with the mid-cabin door plug installed has impacted their on-time statistics during this reporting period.

January 2024 On-Time Arrival

In January 2024, reporting marketing carriers posted an on-time arrival rate of 72.8%, down from both 83.9% in December 2023 and from 76.2% in January 2023.

January 2024 Flight Cancellations

In January 2024, reporting marketing carriers canceled 3.8% of their scheduled domestic flights, higher than both the rate of 0.4% in December 2023 and the rate of 1.9% in January 2023.

Complaints About Airline Service

The release of air travel service complaint data in the Air Travel Consumer Report (ATCR) has been delayed primarily because of the continued high volume of complaints against airlines and ticket agents received by the Office of Aviation Consumer Protection (OACP) and the time needed to review and process these consumer complaints. The Department is investing in modernizing its system for handling consumer complaints with the support of a Technology Modernization Fund (TMF) investment to improve the customer experience for the tens of thousands of consumers who use the system each year and enable OACP to more effectively engage in oversight of the airline industry. 

As DOT modernizes its system, given the continued high volume of air travel service complaints concerning airlines and ticket agents, DOT has revised how it processes consumer complaints received after June 1, 2023. From June 2023 until the date its system is modernized, DOT intends to revise the ATCR to display consumer submissions (complaints, inquiries, and opinions) as opposed to complaints for this period. The Department will continue to display civil rights complaints in the ATCR in a similar manner as before and anticipates publishing submission and civil rights complaint numbers in spring.

Tarmac Delays

In January 2024, airlines reported 71 tarmac delays of more than three hours on domestic flights, compared to five tarmac delays of more than three hours on domestic flights reported in December 2023. In January 2024, airlines reported six tarmac delays of more than four hours on international flights, compared to zero tarmac delays of more than four hours on international flights reported in December 2023. 

Airlines are required to have and adhere to assurances that they will not allow aircraft to remain on the tarmac for more than three hours for domestic flights and four hours for international flights without providing passengers the option to deplane, subject to exceptions related to safety, security, and Air Traffic Control related reasons. An exception also exists for departure delays if the airline begins to return the aircraft to a suitable disembarkation point to deplane passengers by those times.

The Department investigates extended tarmac delays.

Mishandled Baggage

In January 2024, reporting marketing carriers handled 37.4 million bags and posted a mishandled baggage rate of 0.75%, higher than both the rate of 0.50% in December 2023 and the rate of 0.73% in January 2023.

The Department began displaying the mishandled baggage data as a percentage (i.e., per 100 bags enplaned) in January 2022. This is consistent with the manner that the mishandled wheelchairs and scooters rate is calculated and displayed.     In the prior three calendar year reports (2019 to 2021), the Department calculated the mishandled baggage rate based on the number of mishandled bags per 1,000 checked bags. 

Mishandled Wheelchairs and Scooters

In January 2024, reporting marketing carriers reported checking 56,659 wheelchairs and scooters and mishandling 836 for a rate of 1.48% mishandled wheelchairs and scooters, higher than the rate of 1.39% mishandled in December 2023 and lower than the rate of 1.47% mishandled in January 2023.

As described earlier, in February 2024, the Department announced its proposal to strengthen its rule implementing the Air Carrier Access Act (ACAA) to address the serious problems that individuals with disabilities using wheelchairs and scooters face when traveling by air that impact their safety and dignity, including mishandled wheelchairs and scooters and improper transfers to and from aircraft seats, aisle chairs, and personal wheelchairs. The proposed rule would require that airlines meet strict standards in accommodating passengers with disabilities by setting new standards for prompt, safe, and dignified assistance, mandating enhanced training for airline employees and contractors who physically assist passengers with disabilities and handle passengers’ wheelchairs, and outlining actions that airlines must take to protect passengers when a wheelchair is damaged during transport. The proposed rule also clarifies that damaging or delaying the return of a wheelchair is an automatic violation of the ACAA.

Bumping/Oversales

Bumping/oversales data, unlike other air carrier data, are reported quarterly rather than monthly. For the fourth quarter of 2023, the 10 U.S. reporting marketing carriers posted an involuntary denied boarding, or bumping, rate of 0.20 per 10,000 passengers, lower than both the rate of 0.35 in the third quarter of 2023 and the rate of 0.30 in the fourth quarter of 2022.

Incidents Involving Animals

As part of its IT modernization, DOT’s Office of Aviation Consumer Protection (OACP) is improving the options for covered carriers to submit their monthly and annual Reports on Incidents Involving Animals During Air Transport. While the new system is being developed, OACP is permitting covered carriers to delay submission of reports on incidents involving animals during air transport. Annual data on such incidents will be published when DOT receives carriers’ complete submissions of the 2023 data. 

In January 2024, carriers reported zero incidents involving the death, injury, or loss of an animal while traveling by air, equal to the zero reports filed in both December 2023 and in January 2023.

Minister of Transport Eamon Ryan has turned the sod on a transport hub project for Bray station in Co Wicklow.

At a cost of €3.5 million, the project will realign bus services at Bray’s Daly Station, upgrade pedestrian and cycling facilities with new widened footpaths and pedestrian crossings, and introduce new seating areas and tree planting.

The project, which is supported by Irish Rail , was designed by consultants Atkins Réalis, with contractors David Walsh Civil Engineering carrying out the works.

Taoiseach Simon Harris, who is a Wicklow TD, said in a statement he was delighted with the project, which “is set to have a significant impact on people across the county providing high-quality public spaces to go alongside the historic station buildings we are already lucky to have”.

The Taoiseach said “we will see renewed energy and activity in the local area which small businesses will no doubt welcome”.

Speaking at the sod turning, Mr Ryan said the “new transport hub is going to transform the area around Bray train station and encourage more people to choose public transport. We are seeing throughout the country that when we improve transport infrastructure and facilities, people respond so positively.

“Bray is a wonderful, thriving town and it is about to get even better with this new plan from Wicklow County Council, for locals and commuters first, but also to the many people who visit.”

Wicklow County Council deputy chief executive Michael Nicholson said the active travel project was “one of many” being rolled out across the county.

“Ultimately the project will benefit the key transport modes of walking, cycling, taxi, bus and rail at the station, and will encourage a modal shift from private vehicles to more sustainable modes of transport,” he said.

Works will be carried out on a phased basis, with access to businesses, residences, public transport and amenities maintained throughout. Alternative access routes required during construction will be highlighted in advance.

L1 Dulwich Hill Line weekend partial closure due to emergency repairs

From 6am to 4.30pm Saturday 20 April , L1 Dulwich Hill Line light rail services will not run between Lilyfield and Dulwich Hill due to emergency repairs on the nearby train network, following a recent severe weather event.

During this time:

  • Use alternative transport including replacement bus services or regular bus services between  Lilyfield  and  Dulwich Hill.
  • If possible, walking is an alternative transport option for travel due to increased road traffic.
  • L1 light rail services will continue to run between Central Grand Concourse and Lilyfield as per normal frequency.

Replacement bus services:

  • Due to the short notice of the emergency repairs, the replacement bus services may not be showing when planning your trip via Trip Planner and the transport apps.
  • L1 replacement bus services will run every 12 to 20 minutes from 6am to 4.30pm; these times may vary depending on road traffic.
  • Most replacement buses will be  accessible ; if not, wait for the next service.
  • You must tap on and tap off when boarding and alighting replacement buses. Opal readers are located onboard all replacement buses. A standard light rail fare applies.

L2 Randwick Line and L3 Kingsford Line light rail services will continue to run as per normal schedule.

Allow extra travel time and use the  Trip Planner  or check  travel alerts  to see if your travel is affected.

L1 light rail services  between Central Grand Concourse and Dulwich Hill will resume as normal from 4.30pm   Saturday 20 April .

Dubai: Though most of Dubai roads have been opened for traffic, motorists are advised to avoid some roads which are still partially closed due to rain water logging after recording breaking rains in the UAE on April 16 and 17.

Authorities concerned included the Roads and Transport Authority and the Dubai Municipality are working tirelessly to resume normal operations on the road, some roads in the emirates are still closed due to rain water flooding.

Motorist should plan their journey before starting their commute either using their cars or the public transport.

Most streets in Sharjah Industrial areas are also closed due to flooding.

Which areas and services resumed

Earlier, RTA confirmed on its X handle the return to regular service for certain routes on the Red Line of the Dubai Metro, spanning from ‘centrepoint’ to ‘Dubai Internet City’ and from ‘Jabal Ali’ to ‘Expo 2020’.

Similarly, services on the Green Line, from ‘etisalat by e & ’ to ‘Abu Hail’ and from ‘Creek’ to ‘Al Ras’, have resumed. Efforts are ongoing for the gradual restoration of service to the remaining stations and lines.

Sheikh Zayed Road

RTA advises drivers that Sheikh Zayed Rd. is now accessible from Dubai World Trade Centre Roundabout to Intersection 9 heading towards Abu Dhabi.

RTA warns that delays may occur in certain lanes on Sheikh Zayed Road due to water accumulation, as efforts are underway to address and clear this issue.

Taxi Service

The Roads and Transport Authority confirms that taxi and public bus services have returned to their previous status, and that work is underway to avoid any obstacles, with the ability of Dubai residents to accommodate the weather conditions to which the emirate was exposed.

Dubai Tram and Metro

RTA says that the DubaiTram is now running smoothly as per its regular schedule, with all Tram Stations operating at full capacity.

The Metro service is operating normally at the following stations, with bus services available for commuting between the affected stations:

 From Jabal Ali Station to Expo 2020 Station

 From etisalat by e & Station to Abu Hail Station

From Creek Station to Gold Souq Station

RTA tweeted: “Please note that Dubai metro is currently operating as per the operational hours on Red line in the following stations: from Centrepoint Station to Business Bay, from Jabel Ali Station to Expo2020. On Green line in the following stations: from etisalat by e & station to Abu Hail station and from Creek station to Al Ras station. Work is ongoing to open the rest of the stations gradually.”

RTA assures that operations have returned to normal at Vehicle Inspection Centres and Customer Happiness Centres.
