Whilst many of these trips are booked online directly through flight providers and brokers, travel agents still play a significant role in facilitating holiday arrangements. Whether you’re looking to start your own independent travel agency or work as part of a consortium, this article will take you through everything you need to consider.

What is a travel agency?

There can be some confusion around the role of a travel agency and a tour operator. In short, one sells holidays, the other organises them.

A tour operator focuses on the operational aspect of holidays – contracting, booking and packaging together elements such as travel, accommodation and tours. Some tours operators you might know (such as TUI) are customer facing but also sell holidays to a travel agency who act as a middleman. Some tour operators you might not know (such as Gold Medal) are trade only.

Tour operators can only sell the products or services that they offer so are not always impartial.

A travel agency should only sell and administer these packages to clients based on their requirements. Travel agents will liaise with multiple tour operators with complete independence and impartiality to ensure a getaway meets expectations by providing the necessary information and payments on a client’s behalf.

Agents can also sell the individual elements of a holiday such as flights, hotel rooms, tickets and attractions.

Why start a travel agency?

Many argue that the internet has taken away the requirement for travel agencies, as it enables people to book directly with service providers. With the middle person removed, a saving is made. While ABTA’s Holiday Habits Report 2018 states that the preferred method for booking a holiday abroad is directly through a service provider, it also states the next most popular methods are through a holiday booking website (e.g. Booking.com) and a travel company or travel agent.

  The report continues to list the main reasons people book with travel professionals:

  • Ease of booking
  • Saves them time
  • Booking confidence

Even though people are equipped with the means to go direct, a large proportion still turn to the professionals. There is clearly still a place for travel agencies in the travel and tourism industry.

What type of travel agency should I start?

There are a few ways you can run a successful travel agency business. Here are three options worth exploring before deciding your next step:

Independent agency

If your dream is to start your own business where you call all the shots, then starting an independent travel agency is the best option. With this option, you’ll have entire control over who you work with, who you employ, and branding, etc.

You might want to specialise in a particular type of holiday or destination to focus your offering. Being an expert will give customers a reason to trust you. You’ll be able to offer the highest quality service by focusing your knowledge rather than spreading it thin. It will also shape your brand identity and USP , helping you stand out within a competitive industry. Specialisms can include luxury, adventure, cruise, family, wedding and honeymoon, as well as specific destinations.

Travel consortium

Cash is an essential commodity during the first few years as a startup, so you might want to consider joining a travel consortium to cut down on overall costs.

A travel consortium is an organisation made up of independent travel agents and agencies. They collaborate to increase their buying power and commissions. You can start your own travel business but enjoy the flexibility and better work/life balance by working for travel homeworking companies such as InteleTravel , Holiday Franchise Company   and Travel Counsellors . InteleTravel

InteleTravel is recognised by every major travel supplier in the world. You don’t have to have experience in the travel industry to qualify – just a passion for travel and the ability to influence people’s travel choices. You can work full-time, part-time or even enjoy it as your hobby. It charges homeworkers a £142 sign-up fee and a £32 monthly charge. Agents keep 70% of the commission paid by suppliers, but this can rise to 80% if sales targets are met.

Homeworking companies such as InteleTravel have raised some eyebrows in the UK for employing staff with no industry experience. They believe this approach devalues the role of a trained and experienced travel agent and some go as far as calling it a pyramid scheme. But 1,800 agents in the UK have already signed up. Notably, InteleTravel was granted ABTA membership in March 2019, meaning it’s now bonded as a retail travel agency in the UK having met ABTA’s financial and regulatory criteria.

Another option is the Holiday Franchise Company . They’re a UK-based travel franchise accredited by both the British Franchise Association and the Approved Franchise Association. They were the first travel franchise to appear on the Elite Franchise top 100 for 2020. Their training program has been accredited by The Institute of Travel & Tourism and are part of the hugely respected Holidaysplease.co.uk .

Travel Counsellors  is a consortia made up of travel agents who are homeworkers. People are invited to start their own franchise with them and again – you don’t need to have industry experience to apply. You will become a self-employed franchise holder arranging bespoke travel experiences for your clients. You make money by earning commission on all the travel experiences you sell. The commission is split 60/40 with them (60 for you). ‘For that 40%,’ outlines Travel Counsellors, ‘we’ll provide you with unrivalled support and continuous investment in your business.’ You’ll also receive:

  • Financial protection for everything you book for your clients
  • Access to their integrated digital platform, which helps you source and book the holidays.

As both a travel agent and business owner, you’ll need to have a variety of skills and characteristics:

Login or Register

Make sure information on your file is correct. For example, having a wrong address on your file will have an impact on your score. There may be other problematic items that you can identify – for example, if your score is linked with someone with bad credit or there’s fraudulent activity on your account. 

If you have a history of late payments, this will show in your credit history. The sooner you can start demonstrating to lenders that you are less of a risk, through regular payments and by clearing existing debts, the better chance you’ll have of securing finance.

If you are trading as a limited company and you are late filing your accounts at Companies House, this will have an impact, so get it sorted as soon as possible. Make sure that you provide your accountant with all the information they need – get those accounts registered quickly each year.

Don’t try and pull the wool over the eyes of prospective lenders. It’s better to provide them with the full picture, even if there are things that you're not keen to talk about. They’d rather have an up-to-date picture of your situation than no information at all. 

Avoid making lots of credit applications in a short space of time. Every time an application is made the credit search will be visible on your file. This can reflect badly as it indicates to lenders that you may be desperate or, alternatively, ‘shopping around’.

What rules and regulations are there?

You are required by law to provide a bond to reimburse clients if your company fails financially. You can arrange this with a bank or insurance company.

You don’t need any qualifications to become a travel agent, however, joining a trade association will tell both customers and industry that you take your responsibilities seriously. It tells suppliers your business is well supported, while reassuring customers that their money is protected.

The two most well known are ATOL and ABTA. 

Air Travel Organiser’s Licensing (ATOL)

This license allows you to sell airline tickets. Without it, you’d be confined to providing accommodation and ground transport only. Every UK travel company that sells overseas holidays and flights is required to hold a license in the event that a company ceases trading. It will refund consumers if their holiday is cancelled while covering hotel costs and flights home if they’re already abroad. It’s a financial protection scheme designed to reassure consumers that their money is safe.

When you send your customers booking confirmation, it’s a legal requirement to send your ATOL certificate with it. It’s also worth noting that flights booked directly with airlines are not ATOL protected.

You can apply for a small business ATOL license if you intend to send less than 500 passengers a year with £1m or less revenue and intend to keep the numbers at the same level within the first three years.

Association of British Travel Agents (ABTA)

ABTA deals with non-flight based holidays, linked travel arrangements and travel agents. As a member, you must properly protect your package holidays, as required by law. Packages not including a flight e.g. coach, rail, cruise, are covered by ABTA bonding or insurance policies.  

Similar to ATOL, it covers transport and accommodation should a supplier no longer be able to look after them. This protection applies to packages sold in the European Economic Area. 

All travel organisers can apply to be an ABTA Member. You must abide by ABTA’s regularly updated Code of Conduct to become certified – an accolade that most consumers look for when booking a holiday. It also updates its members of any changes to regulations and protects both the consumer and agency should holidays fall through. The Travel Trust Association (TTA)

The TTA offers a more flexible, low-cost option if you’re looking for an alternative to bonding arrangements. Travel companies under this membership offer customers unrivalled financial protection, as all money is secured into your own Trust account and guaranteed by the TTA.

AITO Specialist Travel Agent

You might want to consider the Association of Independent Tour Operators (AITO), as they offer members specialist products from smaller tour operators, as well as financial protection for consumers. Package Travel and Linked Travel Arrangements Regulations 2018

It is now a legal requirement that holidays worldwide sold by UK companies should be protected. Since July 2018, package holiday protection was extended to cover consumers who choose different suppliers via a single website e.g. online travel agents (OTAs), call centres or a shop. If something goes wrong, holidaymakers who book their holiday online will now be compensated in the same way as someone who booked their holiday via a travel agent. Under the European directive:

“Traders should be required to state clearly and prominently whether they are offering a package or a linked travel arrangement, and provide information on the corresponding level of protection, before the traveller agrees to pay.”

This legislation is under EU rules, so make sure to keep an eye on this and other similar requirements during and post-Brexit.

GDPR (General Data Protection Regulation)

Do I Need A Travel License For My Business?

Do i need a travel license to run a travel business in the uk.

The PTS team are approached on a daily basis by international trading travel businesses and UK start-ups with the same question: “Do I need a travel license to run a travel business in the UK?”

To run a tour operator or travel agency in the UK it is a regulated market and it is becoming even more stringent with the introduction of The New Package Travel Directive . However, the regulations are purely in place to protect consumers, not to make business within the travel industry difficult.

At PTS we appreciate that there is a huge amount of information to process and it can appear confusing and overwhelming when you are starting up in travel or simply looking to bring your travel business to the UK market.

There are two areas that a tour operator or travel business must consider.

ATOL – Air Travel Organisers License

If your company wants to sell flights, or include flights in the packages that you offer to your clients, then your travel company will need an ATOL.

PTR Compliance – Package Travel Regulations Compliance

Most tour operators sell two or more elements. When we say elements we mean:

  • Accommodation
  • Food/catering
  • Booking activities through external suppliers.
  • Spa treatments

The above list is not exhaustive. We are just purely offering some examples to highlight elements of a package.

Travel businesses, or travel advisors, that are arranging two or more elements from the above list would generally need to be PTR compliant.

So, to clarify – there are two separate areas that are regulated, ATOL and PTR. You may need both, or, you may just need to be PTR compliant if you are not selling flights. But, you must ensure client monies are secure when you work in travel.

In this second part of our overview of the law of travel agency, we explain some of the legal practicalities to consider when setting up a travel agency and why the Package Travel and Linked Travel Arrangements Regulations 2018 are important to understand. You can read part one: the basics of an agency relationship here . 

How does one become a travel agent?

In order to be a travel agent in the legal sense, the travel company must be appointed by its principal (e.g. a hotelier) as its agent. This is typically set out in a written agency agreement, which will determine the rights of the parties. In addition to this formal appointment, the travel agent must then ensure that it discloses the fact that it is acting as an agent to third parties (e.g. consumers) and that it does not give third parties the impression that it is acting as a principal.

The law will generally respect the terms of the contracts entered into by the parties. If the contract denotes a travel company as an agent, then that will usually determine the issue. However, there could be situations in which the courts would disregard the terms of the contract if it found that the contracts were a “sham” and/or did not properly reflect the economic reality of the relationships between the parties. Indeed, the UK tax authorities have tried to pursue this argument in relation to the business models of a number of online travel agents. So far it has failed, primarily because of the emphasis given by the courts on the importance of the courts respecting the terms of contracts.

How does the creation of a package holiday affect the travel agent’s status?

The involvement of the travel agent in the creation of an itinerary for the consumer might lead to the creation of a package holiday (or a linked travel arrangements) under the Package Travel and Linked Travel Arrangements Regulations 2018. Moreover, if the travel agent sells a flight to the consumer, whether on its own or as part of a package holiday, then the travel agent might be required to hold an ATOL pursuant to the ATOL Regulations 2012.

Does this change the status of a travel agent into a principal?

The short answer is “no”, provided that the travel agent is careful to ensure that the sale process and the consumer “paperwork” maintains its status as a travel agent. There is otherwise a risk that the travel agent may end up selling a package of travel services under a single contract to the consumer and so act as a principal.

The next part of our overview of the law of travel agency will focus upon the relationship between the principal and the consumer and secondly, on the relationship between the principal and the travel agent. We will look at the rights and obligations which arise under these relationships.

Rules and regulations of running a travel business

You don’t need any qualifications to set up as a travel agent, so in effect anyone could do it – although it will greatly increase your chances of success if you join a trade association. That is, customers and industry are unlikely to take you seriously without.

The most widely recognised trade association is the Association of British Travel Agents (ABTA) although this is also the most expensive and therefore aimed less at start-ups than the Travel Trust Association (TTA) or the Global Travel Group.

“I joined ABTA from the beginning,” says Martin Jones of Freedom Direct, a call centre based travel agency. “It has a regularly updated code of conduct and keeps me up to date with changing regulations and generally gives both my customers and me protection (insurance cover if the holiday falls through).”

You are required by law to provide a bond to reimburse clients if your company should fail financially, this is arranged with a bank or insurance company. Also, you have to have Air Travel Organisers Licensing (ATOL) which allows you to sell airline tickets. Without it you would be confined to providing accommodation and ground transport only.

Global Travel Group is a franchised operation so it holds bonds and ATOL centrally, whereas ABTA requires that you have a certain amount of capital to hold them yourself. The latter is more expensive, although it allows you to be more independent.

Membership of a trade association tells suppliers that you have a strong and supported business and customers will be reassured knowing their money is protected.

The level of on-going support with us is really crucial for someone who has never worked in travel before.  From the two week training course for two people up to an IT support desk, we are there to help you build and grow your business.  The licences you need to trade and also to give you and your customers peace of mind.

Well, that depends on you and factors such as how many hours you work, how much you advertise and what you sell. A typical holiday booking is £2,500 after our small management fee is deducted you will earn £312.50, if you were to average 1 booking per day your gross earnings for the year would be in excess of £110,000.

Everyone looks forward to getting away from it all, taking a well-earned holiday from the usual day-to-day grind, and although some book online, a travel agent is still the first port of call for many holidaymakers who want to know that help is on the end of a phone if they need it.

If you want to become a travel agent and book peoples’ dream holidays, are there any regulations and do you need a licence or any sort of bonding?

What is a travel agent licence? 

In the UK, while you don’t need any formal qualifications to become a travel agent, it is advisable to have an ATOL licence and be a member of ABTA. You will need some sort of bonding or a licence, depending on the type of holiday you intend to sell. 

The industry is highly regulated and licences are designed to protect the consumer when something goes wrong. If the airline company cancels the flight, or the hotel closes, for example, the relevant travel agent licence protects the holidaymakers financially, reassuring them that their money is safe. It also provides customers with the promise that they are not going to be stranded somewhere with no way of getting home should a company cease trading.  

A different licence or bonding is required for each type of holiday you intend to offer. To book airline flights, for example, you’ll need an ATOL (Air Travel Organiser’s Licence), and for non-flight-based holidays, ABTA (Association of British Travel Agents) bonding is advisable.

The size of the ATOL licence can vary depending on the amount you’ll need to reimburse consumers (see below). If you are arranging holidays for less than 500 people every year, in the event of a cancellation, fewer people will be requesting refunds, and therefore the cost will be less.

ATOL issues four types of licence:

  • Standard ATOL – this is for agencies that plan to carry in excess of 500 passengers per year
  • Small business ATOL – this is necessary if you plan on selling less than 500 flight-based holidays every year
  • ATOL to ATOL trade sales – if you intend to sell to other ATOL licence holders, you’ll need this licence 
  • Franchised ATOL – if you expect to sell a maximum of 1,000 flights or holidays per year and are a member of an approved travel trade organisation, you’ll be required to have a franchised ATOL licence

It’s important to note that flights booked directly with airlines lack ATOL protection. 

ABTA (Association of British Travel Agents)

Dealing with non-flight-based holidays, an ABTA licence covers customers travelling by train, coach or ship. ABTA is the most widely recognised trade association and offers a package that provides detailed industry updates, legal advice, crisis management and business support. However, ABTA membership can be expensive, especially if you are just starting your travel agency. 

TTA (The Travel Trust Association)

Providing a low-cost, flexible alternative for travel agents wanting financial protection for themselves and their customers, the TTA offers an attractive package. 12. Do I need a visa to travel to the UK?

Whether or not you need a visa to visit the UK depends on the length of your stay and your nationality. For example, if you’re a citizen of the USA, Canada, Australia or an EU or EEA country, among others, you won’t require a visa. But it’s essential that you bring your valid passport for entry into the UK.

13. What sort of accommodation will I stay in?

14. Can I choose the arrival date?

Of course! With Nordic Visitor’s UK self-drive tours , you can begin your trip anytime from April to October.

For guided small group trips in the UK , select the departure that works best for you from a list of start dates between August and September. If you want to travel at a specific time of year, book early in case your preferred departure is filled.

You can check each tour’s availability calendar online to see what dates are bookable.

15. Will Nordic Visitor book my flights to the UK?

Flights aren’t included in these UK tour packages. This gives you the flexibility to choose where you’d like to fly from, along with the flight times and prices that work best for you. If you have any questions about your journey to the UK, don’t hesitate to ask your local travel expert for advice.

Before booking your tour package, we highly recommend checking what flights are available. But please wait until after your trip is confirmed to make your travel arrangements.

Once you’ve received an email confirmation from your dedicated consultant, you can go ahead and purchase your preferred flights.

16. What should I pack for my trip?

No matter when you decide to visit, you can expect the weather in the UK to be changeable. So while the driest weather is between April and October, it’s worth being prepared for both rain and shine. Not to mention the fact that the temperature can vary a lot, depending on the season and where you are in the UK.

For instance, at the height of summer in London, you might experience temperatures over 30°C (86°F). Meanwhile, at the same time of year in the Scottish Highlands, the average temperature is around 15-17°C (59-63°F).

If you plan to spend time outdoors, pack these essential items and you’ll be covered from spring through to autumn:

  • Waterproof jacket and trousers
